Terms & Conditions
- KitchenSynch sells as agent for the seller and as such is not responsible for any default by buyer or seller.
- KitchenSynch is not the owner or the seller of the goods, but merely a bailee, acting on behalf on the seller to facilitate the sale of the goods by holding the goods until such time as the sale is completed and the goods transfered to the buyer.
- The seller warrants to KitchenSynch and to the buyers that he is the true owner of the lot or is properly authorised to sell the lot by the true owner and is able to transfer a good and marketable title to the lot free from any third party claim. The seller will indemnify KitchenSynch, their servants, agents and the buyer against any loss, damage or liability suffered by them in consequence of any breach of the above warranty on the part of the seller, howsoever arising including all costs and expenses incurred by KitchenSynch or on their behalf in dealing with any such claim.
- All statements on auction websites and advertisments of forthcoming sales as to any matters specified in this paragraph are statements of opinions and are not, nor are they to be relied upon as, statements or representations of facts. Illustrations in the catalogues, advertisments or brochures of forthcoming sales are solely for the guidance of intending purchasers and are not to be relied upon in terms of tone or colour or necessarily to reveal imperfections in any lot. Intending buyers must satisfy themselves by inspection on otherwise as to all matters, as to the physical description of any lots and as to whether or not any lot has been prepared.
- Neither the seller nor KitchenSynch are responsible for the correctness of any statement as to the authorship, origin, date, age, attribution, authenticity or provenance of any lot or any other areas of description.
- Neither the seller nor KitchenSynch are responsible for any faults or defects in any lot.
- Neither the seller nor KitchenSynch nor any person in their employ, make or have any authority to make any representation or warranty nor are they responsible for any representation or warranty or any statement on auction websites and advertisments of forthcoming sales therein.
- KitchenSynch have absolute discretion without giving any reason to refuse any bid, to divide any lot, to combine any two or more lots, to withdraw any lot from the auction and in case of dispute put up any lot for auction again.
- The highest bidder acceptable to iapplaince shall be the purchaser. If, during or immediately after the sale of the lot KitchenSynch considers that a dispute has arisen or that there is any other reason for doing so, he may at his absolute descretion immediately put up the lot again for sale or, alternatively, he shall be the sole arbitrator in any dispute between two or more bidders and his decision shall be final and binding on all concerned.
- The seller authorises KitchenSynch to deduct commission of 30% of the purchase price up to £1,000 and 20% thereafter. Where KitchenSynch has to make collections of items from the seller's premises a nominal fee will be charged.
- Where a seller cancels instructions for the sale, KitchenSynch charge a cancellation fee of £10.
- KitchenSynch commits that it will not release any goods until full clearance of funds has been confirmed.
- In the event of accidental lose or damage, KitchenSynch will pass on monies received from the insuring agant equating to the final sale price, or in the event of an item having not yet been sold for the agreed estimate less KitchenSynch fees.
- KitchenSynch shall remit the proceeds of the sale to the seller not later than 14 days after the buyer has paid for and collected the lot.
- Where any lot fails to sell, KitchenSynch will notify the seller according. If the lot is not collected within 7 days of notification, KitchenSynch reserve the right to resell the item.
- In addition to the above Terms & Conditions of sale, all Terms & Conditions as set by the internet auction site used will apply.
